Encounter Dating Terms & Conditions

Encounter Dating provides its event ticket holders with an opportunity to meet each other at events hosted by Encounter Dating and to mutually match after an event using our event matching platform Encounter Match. Encounter Dating also provides a matchmaking service. These Terms and Conditions (T&C) apply to Encounter Dating and to Encounter Match, including our matchmaking and dating service.

This Agreement sets out the legally binding terms for registering with Encounter Dating, for participation in all Encounter Dating events, for using Encounter Dating's matchmaking service and for use of our matching platform Encounter Match. You may terminate your registration at any time without explanation, effective upon sending written notice to Encounter Dating. Encounter Dating may terminate your registration without notice at any time for any reason. Encounter Dating reserves the right to immediately suspend or terminate your access to our events, Encounter Match or matchmaking services, without notice, upon any breach of this agreement by you which is brought to our attention. Until such time though, this Agreement will remain in full force and effect while you are registered with us, participate in any Encounter Dating events or use Encounter Match or our matchmaking services. By registering with Encounter Dating, participating in Encounter Dating events or using Encounter Match or our matchmaking services, you agree to be bound by the terms and conditions of this Agreement. Encounter Dating takes all reasonable steps to keep all information supplied by you confidential.

Encounter Dating reserves the right to review and change any of the terms by updating these terms at its sole discretion. Any changes to the terms take immediate effect from the date of their publication.

If Encounter Dating is sold, we reserve the right to transfer without notice your personal information, including any rights collected and agreements made with you.

Definitions

Encounter Dating is referred to as "our", "we", "us" and "its" throughout the Terms and Conditions.
Any reference in this agreement to “you” or "your" is a reference to any person accessing or browsing this website.
The term Encounter Dating also includes Encounter Match and all matchmaking services.
Any reference in this agreement to a “registered member” is a reference to any person who is a registered Member of Encounter Dating or Encounter Match, or who has created a matchmaking profile.
Any reference to a registered member attending a “date” with another member is a reference to an agreement between two individuals that they are to meet each other at a particular time and place with a view to getting to know each other and becoming better acquainted.

Acceptance of the Terms

You accept the terms by clicking to accept or agree to the terms where this option is made available to you by Encounter Dating on its registration and ticketing pages, prior to registering or purchasing tickets, or when you make a matchmaking profile. If you are booking for more than one person, you will be deemed to have accepted these terms and conditions on their behalf and made them aware of these terms and conditions and their obligations hereunder. By purchasing a ticket to an event, joining an event waitlist, registering to use Encounter Match, or creating a matchmaking profile, you agree to receive future event invitations and marketing material. You can unsubscribe at any time by clicking the 'unsubscribe' link at the bottom of our email invitations.

Events Policy

Encounter Dating may offer you the opportunity to attend singles events run by Encounter Dating. The events have a specific age range and you must be within that range to be eligible to attend the event. Encounter Dating allows guests to be outside of our recommended age brackets by a maximum of 2 years for some events and this will be specified in the event listing. This means if you are more than 2 years below or more than 2 years above the age group for an event, you will not be permitted to attend. Encounter Dating reserves the right to check your photo ID to confirm your name and age at any of our events. If you refuse to show your photo ID when asked, we will refuse your participation in the event and you will be banned from attending future events. No refund of any payment will be made under these circumstances.

To attend an event run by Encounter Dating you must be 18 years or older. Encounter Dating does not accept any registrations to our singles database by people under the age of 18. If we have been made aware that you have provided any misleading or false personal information to us, you will be banned from attending any of Encounter Dating’s events and you will not be issued with a refund under these circumstances. This includes the use of false names and/or providing an incorrect age. Encounter Dating has the right to ban you from any events at our discretion for any reason.

By attending an Encounter Dating event and creating a profile on our matching platform Encounter Match you consent to Encounter Dating displaying your photo and first name to anyone that has registered to use our matching platform for the same event. In addition to your photo and first name, only your preferred contact details that have you have selected when creating your profile, such as mobile number or email address will be shared with any 'mutual' matches that you receive. You can delete your Encounter Match profile at any time by clicking 'Delete Account' within your profile.

You can unsubscribe from Encounter Dating at any time by clicking the ‘unsubscribe’ link at the bottom of any event invitation emails we send you.

Cancellation Policy

Should an event need to be rescheduled or cancelled due to Government COVID-19 restrictions, weather, insufficient numbers, venue changes or other unforeseen circumstances beyond our control, you will be notified by email and will receive a credit to the value of your original purchase which can be used towards a future event.

If we receive a cancellation request from you at least 48 hours prior to the event you will be issued with a credit up to the same value as your original purchase to use towards a future event. If we receive a cancellation request within 48 hours of the event, you will only be issued with a credit if we have been able to fill your place. Any credits issued must be used within 12 months from the date of issue or will be forfeited and once redeemed a credit can not be reissued or transferred to another event. If the ticket price of the event you choose to redeem your credit on is less than the value of your credit, the remaining balance cannot be carried forward and will be forfeited.

If you have purchased a ticket to an event and you do not attend the event or leave the event early, you are not eligible for a refund or credit under any circumstances. If you arrive more than 30 minutes late to an event and have not notified us prior to the start of the event, we may refuse your participation at the event if your arrival would cause disruption to the running of the event and you will not receive a refund or credit.

If we become aware that your behaviour has been inappropriate, offensive, or abusive to other guests or staff, you may be removed from the event without any refund and you will be banned from attending future events.

While we aim to have an equal number of male and female attendees at every event, this is not guaranteed and may not always be possible due to attendee no-shows and last minute cancellations. While we do understand that people’s schedules can change, we ask our guests to notify us with as much notice as possible so we can invite another guest to take your place.

Matchmaking Policy

Encounter Dating may offer you the opportunity to attend a date with another registered member arranged by Encounter Dating.

To use or set up a profile for our matchmaking service you must be 21 years or older. Encounter Dating does not accept any matchmaking profiles for people under the age of 21. If we have been made aware that you have provided any misleading or false personal information to us, you will be banned from attending any of Encounter Dating’s events or matchmaking services and you will not be issued with a refund under these circumstances. This includes the use of false names and/or providing an incorrect age.

You can unregister with Encounter Dating at any time by clicking the ‘unsubscribe’ link at the bottom of any emails we send you. This will also stop you from receiving any promotion codes, discounts, free tickets and any other correspondence we send out.

Encounter Dating does not offer any refunds on our matchmaking service under any circumstances.

Waiver and Release

I waive, release and discharge Encounter Dating and the event sponsors from all claims or causes of action I may have arising from any injury, loss or damage of any kind suffered by me including personal injury, illness or death and/or loss or damage to any property (in so far as this does not breach the provisions of the relevant Australian Consumer Law) arising either directly or indirectly out of my attendance at or participation in any event organised by Encounter Dating or out of my attendance or participation in any date arranged by Encounter Dating.
I agree to adhere to all event rules and conditions. I understand that I must follow and obey all directions and instructions given by event hosts and date organisers. Encounter Dating reserve the right in their discretion to reject or cancel my entry to an event at any time, including without limitation for safety of other guests or insurance reasons.
I acknowledge that Encounter Dating or the venue management may remove me from any event area:
- on medical, health, safety or security grounds (including to prevent possible harm or injury to myself or any other person),
- to prevent damage to any property,
- if my behaviour is inappropriate, offensive, or abusive.
I indemnify and will keep indemnified Encounter Dating and each event sponsor against any inappropriate conversations I may have with any other guests at any event as well as communications, dates or meetings that I arrange on my own volition and on my own time with others who have participated in an Encounter Dating event or matchmaking service. I agree that I take sole and complete responsibility for all actions that might occur during any meeting, communication or date.
Encounter Dating does not make any guarantees of any kind in relation to its services.
I indemnify and will keep indemnified Encounter Dating, each event sponsor and each dating venue operator for the actions of myself or any person that I may meet through an Encounter Dating event or through any date arranged by Encounter Dating.
I take sole and complete responsibility for all of my actions that might occur during any event, meeting, communication or date.
While Encounter Dating does screen the information guests provide in their online registration form in order to place them into the most suitable group possible, we do not perform character checks, background checks or police checks of any kind on any individuals participating in our events.
I release all rights of any photos or videos taken of me at an event for use on the Encounter Dating website or for their business promotion purposes. I also understand that:
- If I do not want my photo to be taken or to feature in a video I can tell the photographer and the photographer will respect my wishes,
- If I am posing for a photo or video I am giving the photographer consent to take the photo or video to be published as stated above.

Encounter Dating Reserves the Right

Encounter Dating reserves the right to refuse entry to any guests. We also reserve the right to ask you to leave, or to arrange for your removal if you do not voluntarily leave, after being granted entry, for reasons such as intoxication, aggression, bullying or any other inappropriate behaviour that may offend others or put any of our guests, staff or our reputation at risk.

Encounter Dating reserves the right to refuse our matchmaking service to anyone we feel we are not able to find a suitable match for, or who has breached our Terms and Conditions on previous dates.

We may refuse our service to you under any of the following circumstances:

Complaints have been made about your behaviour or demeanour by other attendees at any event or date.
You have not received any matches at two or more previous singles events. You may have done nothing wrong, however we would rather not take your money if we don't feel we can offer you any mutual matches with our members.
Have left during an event without good reason and without first advising Encounter Dating staff of this reason. Please note that leaving an event without good reason results in disadvantage to the remaining attendees.
Have become intoxicated at a previous event or date.
If we have no guests of the opposite sex who are close to your age, for the event you have purchased a ticket for.
If you have previously met two or more attendees at one of our speed dating events.
In order to keep an even ratio of male to female attendees.
If we are not able to transfer your ticket to a friend for any reason.
Have acted inappropriately towards other event attendees, Encounter Dating staff or venue staff at a previous event or date.
Have provided a false age or misleading information when purchasing a ticket to an event or creating a matchmaking profile.
Have not provided your real name when registering to receive event invitations, purchasing a ticket, or creating a matchmaking profile.
Have not provided sufficient proof of your name or age when asked.
Have not followed the instructions or direction of Encounter Dating staff during a previous event.
At a previous event, have acted in such a way that caused disruption to the running of an event or negatively affected the experience of other event attendees.
